 Post subject: Leaking Diverter Valve

I have a brand new artesian spa. When the jets come on, the water is splashing/cascading against one of jet diverter valves, which is then leaking inside the cabinent onto the pump below, which is causing the GFCI to trip.
the dealer is saying that the water level must be lowered to prevent large amounts of water from getting to the diverter valve.
But this water issue would then re-occur when the tub would be filled with people.
The jets are only 2 inches below the level of the diverter valve, so I would have to lower it below the level of the top most jets and even more when the tub is filled with people ?

Im suspicious of the dealers claims and think the diverter valve should not leak, not matter what.
can someone give me the straight answer ?
